Offences against the person
This type of offence covers all offences of direct or indirect violence, physical or psychological, against another person.
In a non-exhaustive way, we find :
At the level of physical violence, all types of assault (from simple to serious depending on the severity of the injuries), but also much more serious offences such as manslaughter and murder.
In terms of psychological violence, we can name threats to cause certain injuries or death and criminal harassment.
There is a large body of case law on these offences because they are not as simple as they seem, even though some of the realities they describe may seem familiar. For example, why is it legal to hit someone at a field hockey game when it is not necessarily legal in a bar? Is every fight in a bar illegal? Can you be found guilty if you write death threats to the Prime Minister of Canada on your own Facebook page that is only visible to your friends?
If your case involves this type of offence, please contact me and we will discuss it.
