Driving Offences
When we think of this type of offence, we think mainly of impaired driving. Whether it be alcohol or drugs, it is true that this type of offence falls into this category. However, at the criminal level, there are various other offences that fall under this category such as dangerous driving, street racing or police pursuits.
In my experience, despite the seemingly simple phrasing of these offences, they are complex cases to bring to court and often require expert testimony and cross-examination. In this type of case, every detail counts. Moreover, the consequences of these cases rarely stop at the Criminal Court, since, in most cases, the consequences of a conviction (and even before a conviction!) can be felt in many areas of the accused person’s life. For example, a person charged with this type of offence may be denied or restricted the right to a driver’s license with the SAAQ or have his or her automobile insurance fees increased considerably.
